This presentation will examine the tools used by both tribunals and courts to address the multiplicity of proceedings where there is an arbitration agreement.
Amanda Lees, international arbitrator and counsel, will look at when it is appropriate for courts and tribunals to issue anti-suit injunctions against a party to an arbitration agreement pursuing litigation and conversely when it is appropriate for a court to issue an anti-arbitration injunction. In particular, Amanda Lees will look at the competing anti-arbitration injunctions and anti-suit
injunctions in India and Singapore in MSA Global LLC (Oman) v Engineering Projects (India) Ltd and Anupam Mittal v Westbridge Ventures II Investment Holdings.
Often these tools are used in what has been described as “an enforcement war” after an award has been issued. In this context Amanda Lees will also examine the doctrine of transnational issue estoppel and its use to prevent the re-litigation of issues during enforcement of arbitration awards.

Amanda is head of international arbitration at Mallesons. With 25 years’ experience in dispute resolution, she has been based in Singapore for over 14 years.
